The City Council has reviewed Section 2.01 A of the City Charter governing term limits for the office of Mayor and Councilmembers for the City of Allen and desires to amend and clarify such Section 2.01A. If approved, this item would adopt an Ordinance ordering a Special Election for the purpose of giving the citizens an opportunity to vote on two propositions. The propositions would amend the City Charter in the following ways:
Proposition A — If approved, would change term limits to three (3) consecutive terms for each office and would allow a person who has served the maximum number of terms or years to be appointed to fill an unexpired vacancy on the city council. — Would also change the maximum lifetime service from 12 years to 18 years to be consistent with three (3) consecutive terms.
Proposition B — If approved, would change the period of time for which a council member or mayor who has reached the limitation on consecutive terms provided herein must "sit out" from one full term (3 years) to one election year.
Neither Proposition changes the manner of calculating service on the city council for eligibility for election to the city council or changes any other provision of the Charter.
State law requires that a Charter may not be amended more often than every two years. The next available election for a Charter Amendment Election is November 2, 2021.
