Discuss and Consider a Resolution Ordering the Postponement of the May 2, 2020, General Election for the Purpose of Electing the Mayor and City Councilmember for Place No. 2 to the November 3, 2020, Uniform Election Date.

PREVIOUS COUNCIL ACTION:

On February 11, 2020, Council adopted Resolution No. 3731-2-20(R) ordering a General Election to be held on May 2, 2020.

ACTION PROPOSED:

Discuss and Consider a Resolution Ordering the Postponement of the May 2, 2020, General Election for the Purpose of Electing the Mayor and City Councilmember for Place No. 2 to the November 3, 2020, Uniform Election Date.




BACKGROUND

On March 18, 2020, the Governor of the State of Texas signed a proclamation waiving certain provisions of the Texas Election Code and the Texas Water Code authorizing local governments who scheduled elections for the May 2, 2020, uniform election date to delay those elections until the November 3, 2020, uniform election date.  The postponement of the election does not happen automatically; the City Council must take an official action for such a change to be effective.   

 

If the Council adopts the proposed Resolution, the City will begin negotiations with the Collin County Elections Administrator to conduct the General Election on November 3, 2020, and a new Election Order will be presented for Council action prior to August 17, 2020.

 

In addition to the proposed Resolution, attached is a copy of the Texas Secretary of State's advisory providing guidance to local governments regarding the Governor's proclamation.


BUDGETARY IMPACT

The Collin County Elections Administrator has assured the City that if the election were to be postponed to November 3, 2020, that the City would incur no additional cost increases.


STAFF RECOMMENDATION

Staff recommends that the City Council consider the proposed Resolution.

I make a motion to adopt Resolution ______ ordering the postponement of the May 2, 2020, General Election for the purpose of electing the Mayor and City Councilmember for Place No. 2 to the November 3, 2020, Uniform Election Date.
