Ratify the Contract Approved by the City Manager Under a State of Emergency with KCK Utility Construction, Inc. for Repair of the Exchange Parkway Sanitary Sewer Line in the Amount of $177,497.

ACTION PROPOSED:

Ratify the Contract Approved by the City Manager Under a State of Emergency with KCK Utility Construction, Inc. for Repair of the Exchange Parkway Sanitary Sewer Line in the Amount of $177,497.




BACKGROUND

Project Description: During staff inspection of a sanitary sewer manhole along Exchange Parkway (and West of Bray Central Drive, near the Twin Creeks Crossing Apartments entrance), it was discovered that the development of the apartment property had damaged the sewer main and rendered the sewer main inoperable. Additionally, after further investigation (camera inspection in the pipeline), it was found that franchise utility poles where installed directly over and through the sewer upstream of the development causing damage as well. Because the existing sewer main was built for future development to the east and had no flow running through, all of this latent damage went unrealized for more than a year. The damage was not discovered until Twin Creeks North (aka The Legends age-restricted single-family development at the northeast corner of Bray Central and Exchange) was under construction and started contributing flows to the sewer main from construction activity (construction water). At no time was residential sewage running through the damaged line.

 

Due to the extent of the damage, staff had to act quickly and relocate the sanitary sewer line to get it back in operation prior to the completion of the Twin Creeks Village. Staff sought City Manager approval to expedite action, and an emergency was declared under the purview given to the City Manager in such circumstances.

 

Project Support: Installation included a 24" encasement bore to minimize traffic disruption on Exchange Parkway, a new 8" sanitary sewer main, and new manholes. The importance of this line is that it provides service for the new development on the North East corner of Exchange Parkway and Bray Central (The Legends, currently under construction).

 

Construction Contract: KCK Utility Construction, Inc. proposal includes furnishing all labor, materials, equipment, and services necessary to relocate the sanitary sewer line.


BUDGETARY IMPACT

Funding for the construction will use unprogrammed Water/Sewer capital funds initially. Staff will seek reimbursement from the developer and franchise utility company that damaged the line. The Risk Management Division of Human Resources is pursuing a claim with both parties.


STAFF RECOMMENDATION

Staff recommends that the City Council ratify the contract approved by the City Manager under a State of Emergency with KCK Utility Construction, Inc. for repair of the Exchange Parkway sanitary sewer line in the amount of $177,497.
