On February 1, 2019 the City Secretary received a petition submitted by the Allen Police Association requesting recognition as the sole and exclusive bargaining agent for the covered police officers employed by the Allen Police Department for the purposes of "meet and confer". Pursuant to Texas Local Government Code Section 142.103, the City Council must take action on one of three options within thirty (30) days of receiving the petition.
Option #1: Adopt a Resolution accepting the petition requesting recognition as the sole and exclusive bargaining agent for the City of Allen Police Officers and determine that the City may meet and confer pursuant to Subchapter C, Chapter 142 of the Texas Local Government Code.
Option #2: Adopt a Resolution accepting the petition requesting recognition as the sole and exclusive
bargaining agent for the City of Allen Police Officers and order an election
under Texas Local Government Code Section 142.103 (a) (3) to certify that the
association represents a majority of the affected police officers.
Option #3: Adopt a Resolution to defer granting recognition of the association and order an election by the voters in the municipality to be held in conjunction with the City general election of officers in May 2020 regarding whether the City is to operate under the State law allowing a municipality to meet and confer and make agreements.
