| | | | | | | | BACKGROUND
Developers and homeowners associations ("HOA") from time to time request to install custom designed street lights and/or street signs that differ from the City standards. The City requires the developer and HOA to enter into a Facilities and License Agreement that establishes that the design, installation, maintenance, repair, replacement, and removal of the non-standard facilities are the responsibilities of the developer and HOA.
These agreements do not grant an interest in any City-owned real property and do not require the City to incur expenses above what would customarily be spent in budgeted funds for the repair or replacement of standard City-owned street lights, street signs, and support structures.
Since such agreements have become standard and routine matters relating to the operation of the City, staff is requesting the authority be delegated to the City Manager to negotiate and execute such agreements going forward.

Staff recommends that the Council adopt a Resolution delegating authority to the City Manager to negotiate and execute Facilities and License Agreements for design, installation, repair, replacement, and removal of non-standard facilities.
