The Stacy Green development adjoins over 3,200 feet of the north/east bank of Cottonwood Creek between Stacy Road and U.S. Highway 75, and it is along this segment of the creek that the Allen Parks, Recreation and Open Space Master Plan and the Allen Trail Master plan identify the creek corridor as a major city trail and an inter-jurisdictional trail.
This facilities agreement ensures the development of the trail through cooperative considerations and incentives between the developer and the City of Allen. These are summarized herein:
Trail Development
The developer agrees to construct a 12' wide trail extending from the easternmost boundary of Stacy Green at Cottonwood Creek, under and through U.S. Highway 75, connecting to the existing trail within the old Interurban Rail corridor. This will result in continuous trail from the Historic Dam and Water Station north to the trailhead at Rudy's BBQ and west Ridgeview Drive. The City of Allen commits to maintain constructed trails specified in the agreement.
Floodplain Dedication
To construct the trail east of US 75 the City must secure land use rights to floodplain land currently owned by the developer. The developer agrees to dedicate this floodplain east of US 75 to the City of Allen in order to give the City ownership and control of the land and associated trail in its entirety.
The dedicated floodplain land consists of two tracts being 3.56 acres and 0.773 acres each.
Floodplain Maintenance (East of US 75)
Stacy 75 Partners wishes to have control in maintaining floodplain along the development's boundary along Cottonwood Creek. This agreement stipulates that the floodplain that lies between the development and the west trail (Stacy Road to US 75) will be maintained by Stacy 75 Partners. Stacy 75 Partners commits to maintain (including mowing) both sides of the West Trail to a distance of 10 feet from the trail edge.
Parkland Dedication Fee Credit
The developer will be credited for park fees for up to 416 Townhomes/Urban Residential dwelling units for a total credit not to exceed $268,320.
Floodplain Modeling
In lieu of paying for 1/2 of a pedestrian trail bridge across Cottonwood Creek as identified in the Allen Recreational Trail Master Plan, Stacy 75 Partners agrees to have a model of the 100-year floodplain prepared, yielding information useful for the design and construction of such a bridge in the future.
Tree Mitigation
The developer is granted up to a 25% credit toward the net quantity of Hackberry trees removed due to the development of Stacy Green, as well as other lesser stipulations.
The Allen Trail Master Plan identifies a major trail head, and a pedestrian bridge crossing within the Stacy Green Development
