Authorize the City Manager to Execute a Facilities Agreement Related to Owner/Developer Maintenance of the Montgomery Boulevard Median and Traffic Roundabout Landscaping Improvements.

ACTION PROPOSED:

Authorize the City Manager to Execute a Facilities Agreement Related to Owner/Developer Maintenance of the Montgomery Boulevard Median and Traffic Roundabout Landscaping Improvements.




BACKGROUND

This agreement formally identifies the role that the developer, and ultimately the homeowner's association (HOA), will have in maintaining the landscaping improvements within and adjacent to the Montgomery Boulevard median and Traffic Roundabout.

The agreement formalizes the understanding that the HOA will be responsible for paying for all water and electricity used in the operation and maintenance of the landscape improvements, which shall be separately metered in order to allow for the identification of the amount of and cost for water and electricity used for the landscape improvements.


STAFF RECOMMENDATION

Staff recommends that the City Council authorize the City Manager to execute a Facilities Agreement related to owner/developer maintenance of the Montgomery Boulevard median and traffic roundabout landscaping improvements.
