ACTION PROPOSED:

Authorize the City Manager to Execute a Right of Way Use License and Hold Harmless Agreement with Lost Creek Ranch Homeowners Association, Inc. Related to a Subdivision Entry Monument Sign.




BACKGROUND

The Lost Creek Homeowner's Association (HOA) is requesting to enhance an existing monument sign at the subdivision entrance within the median of Country Brook Drive, west of Angel Parkway. The monument sign is located within the City right-of-way. When the HOA applied for a building permit to modify the sign, it was discovered that an agreement did not exist outlining the liability and maintenance responsibilities for the monument sign. This agreement formally identifies that the HOA will be responsible for the maintenance of the sign. The HOA also agrees to indemnify and hold harmless the city and maintain general liability insurance listing the City of Allen as an additional insured.  


STAFF RECOMMENDATION

Staff recommends that City Council authorize the City Manager to execute a Right of Way Use License and Hold Harmless Agreement with Lost Creek Ranch Homeowners Association, Inc. related to a subdivision entry monument sign.
