This agreement formally identifies the role that the developer, JBGL Chateau, LLC, will have in developing Twin Creeks Park Phase II.  Park dedication fees administered through the Allen Land Development Code for the proposed Cypress Meadows Phase II residential community adjacent to Twin Creeks Park in the form of a reimbursable match by the City of Allen, are to be used for the proposed park improvements.   

The attached Facilities Agreement identifies the following:

• JBGL will be responsible, at its sole cost, for engaging the services of a Texas licensed Landscape Architect who shall be responsible for preparing Park Improvement plans based on the Conceptual Plan attached to the agreement.

• JBGL will design, construct, and install the Park Improvements at its own expense.

• The City will reimburse JBGL an amount equal to the lesser of: (1) 50% of the actual costs of the Park Improvement or (2) $175,823.84

JBGL Chateau, LLC. will be reimbursed a maximum of $175,823.84 out of the Park Dedication Fees account for Quadrant or District D for the park improvements.   

Staff recommends the City Council authorize the City Manager to execute a Facilities Agreement with JBGL Chateau, LLC related to the development of Twin Creeks Park Phase II.
